1. CALL TO ORDER

The meeting was called to order at 9:00 a.m. and commenced with the singing of the National Anthem.

2. MINUTES OF THE PREVIOUS MEETING

NOW THEREFORE BE IT RESOLVED that the Minutes of the Regular Meeting of Council held on October 19, 2012, be approved.

3. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER

NOW THEREFORE BE IT RESOLVED that Council receives the Report of the Chief Administrative Officer as distributed.

4. MEDIATION – Shore Road Allowance

i) Thomas Lundy and Janice Papineau
   247 South Shore Road
   Pointe au Baril, Ontario

A mediation meeting was held with respect to a Shore Road Allowance application submitted by Thomas Lundy and Janice Papineau and objected to by the neighbours Michael and Jane Marshall. Joyce Crookshank gave Council a brief outline of the issue and pictures of the site. As well, Joyce spoke to a potential compromise by moving the proposed line. The issues needing to be resolved by this Shore Road Allowance application were the encroachment of the driveway and the need for more lot coverage that would permit the applicants to build an enclosed porch onto their home.

Council asked questions and sought points of clarification and then Mr. Lundy spoke about his application and his agreement to the proposed compromise put forth by staff. Mr. Lundy felt that the shoreline made it extremely difficult for it ever to be utilized in the future, but would give him the lot coverage to permit his addition of a screened-in porch.

Mr. and Mrs. Marshall spoke to Council regarding the potential future development and the impact it would possibly have on their viewscape, and the peace and quiet they currently enjoy. The Marshall's were asked, following their presentation, whether they supported the compromise as put forth by staff.

Mr. Lundy indicated that, after hearing Mr. Marshall, he was no longer in support of the compromise and that he wanted to proceed with the request under his original Shore Road Allowance application.

NOW THEREFORE BE IT RESOLVED that the Council for the Township of The Archipelago supports the sale of the Shore Road Allowance as based on the applicant's original application.

WHEREAS the owners of property located at 247 South Shore Road have submitted an application to purchase a portion of shore road allowance abutting and to the east of their property;

AND WHEREAS the owners of the neighbouring property declined to sign a Preliminary Consent form resulting in a request for mediation by the applicants;

AND WHEREAS a mediation meeting has been held and both parties have been given an opportunity to present their positions to Council;

NOW THEREFORE BE IT RESOLVED THAT Council approves the stopping up, closure and conveyance of that portion of the original shore road allowance adjacent to the applicants' property, north-easterly from the southeast corner of Part 5 of 42R-10602, to incorporate the existing driveway and docks servicing the applicants' property and to accommodate the increased lot coverage required for the proposed 12' by 14' enclosed deck.

Carried.

Councillor Williams declared a pecuniary interest and removed himself from Council.

5. PUBLIC MEETING

i) GEORGIAN BAY LAND TRUST
   Island Nos. 103A and 108A
   In front of the geographic Townships of Harrison/Shawanaga

A Public Meeting was held at 10:00 a.m. to consider proposed Zoning By-law Amendment Numbers Z07-12 and Z08-12 for lands acquired by the Georgian Bay Land Trust.

Cale Henderson spoke to Council on the proposed rezoning and asked if there were any questions. Mr. Henderson then asked if there was anyone else present who wished to speak in support of, or in opposition to the application. Hearing none, the public meeting was closed.

THAT By-law Number A2046-12, being a by-law to amend By-law Number A2000-07, the Comprehensive Zoning By-law, for Island Nos. 103A and 108A, being Parcel 2545 PSNS and Parcel 759 PSNS, located in front of the geographic Townships of Harrison and Shawanaga respectively, be read and finally passed in Open Council this 16th day of November, 2012.

Carried.

Councillor Williams resumed his seat at Council.

i) EQUAL ACCESS TO HIGH-BANDWIDTH BROADBAND RESOLUTION
   SPECTRUM LICENCE AUCTION
   TOWNSHIP OF UXBRIDGE

NOW THEREFORE BE IT RESOLVED that the Council for the Township of The Archipelago supports the Township of Uxbridge Resolution (File No. GF-101) adopted on October 22, 2012, to request the Honourable Christian Paradis, Minister of Industry Canada, to amend spectrum auction rules to allow for the separate auction of rural from urban spectrum, thereby allowing rural Canadians in areas with low population density to access high-speed internet via licensed spectrum.

ii) TAX WRITE OFFS

iii) GAS PRICES COMPARISON

Reeve Ketchum indicated that he would report the findings at the next Heads of Council meeting slated for later this month.

THAT By-law Number 12-45, being a By-law to close and stop up those parts of the Original Shore Road Allowance laid out along the shores of Georgian Bay in front of Lot 32, Concessions 3 and 4, in the geographic Township of Harrison, now in the Township of The Archipelago, District of Parry Sound, designated as Parts 8 and 9 of Plan 42R-19732, be read and finally passed in Open Council this 16th day of November, 2012.

9. OTHER BUSINESS

iv) COMMON SENSE FENCE INITIATIVE

The CAO reported that the request for municipal support for the common sense fence initiative had been forwarded to AMO and its policy team.

v) DREDGING AND DOCKS – LOW WATER LEVELS

As directed by Council, staff is currently working on developing policies and trying to streamline the process with senior levels of government to help property owners deal with this potential problem. Monthly updates will be forthcoming.

vi) POINTE AU BARIL NURSING STATION

The Reeve would like t-he Architect to explain his rationale for the items listed and the amount of time each space is used. Council agreed that Donald Sanderson, CEO for the West Parry Sound Health Centre, and Patty Ritches, Nurse Practitioner, attend the next meeting, along with the Architect Duncan Ross, to explain his report to Council.

vii) SAFE BOATING

Councillor Walker asked that staff forward the information provided by Keith Shantz, on a responsible boating presentation, which he provides for various groups for free.
