1.    CALL TO ORDER

The meeting was called to order at 9:00 a.m. and commenced with the singing of the National Anthem.

2.    APPROVAL OF AGENDA

NOW THEREFORE BE IT RESOLVED that the following items be added to the agenda:  
    1.    The Pointe-au-Baril Ice Rink/Removal of Boards; and
    2.    Update on the meeting with the Parliamentary Assistant to the Minister of Natural Resources and Forestry.

3.    DISCLOSURE OF PECUNIARY INTEREST

Councillor French declared a pecuniary interest on Item # 4 on the agenda, specifically the deputation from William Kennedy, scheduled for 9:10 a.m.

4.    MINUTES OF THE PREVIOUS MEETING

5.    DEPUTATIONS

William Kennedy.  Request for a Right of Way

William Kennedy reviewed with Council his request for a right of way across Township property.  He explained to Council that he has been using this access for many years and that it is the only way to access his garage.

Council directed staff to conduct a site visit, investigate the matter further and report back.

Steven Schell.  Hunting & Fishing Camp

Steven Schell spoke to Council briefly about his lodge which is located fully on Township shore road allowance.  Mr. Schell asked that Council reconsider the proposed solution by extending the 20 year lease agreement to a 25 year lease agreement with a renewal option of a further 25 years; that there be no time limit on use of the lodge; and that Council classify the lodge as a hunting and fishing camp.

Council directed staff to take Mr. Schell’s requests back to the Township solicitor for comments and report back in April.

Parry Sound & Area Food Charter

Jess Nicksy and Jessica Love discussed with Council the Parry Sound & Area Food Charter, including what a food charter is, what the focus areas are, the challenges with our district and what role the Township of The Archipelago can play.

Murray Kennedy.  Pointe au Baril Transfer Station Bottle Drive

Murray Kennedy thanked Council for last year’s donation to the Pointe au Baril Children’s Christmas party.  Mr. Kennedy discussed briefly with Council his ideas and determination to carry on the bottle drive at the Pointe au Baril transfer station.

Council instructed Mr. Kennedy to work with Public Works staff on a practical proposal and report back in April.


6.    OFFICIAL PLAN/ZONING AMENDMENTS

    NOW THEREFORE BE IT RESOLVED that Council receives the Zoning By-law Amendment application and directs staff to circulate it for a future public meeting;

    AND FURTHER BE IT RESOLVED that Council authorizes a donation to the Georgian Bay Land Trust, in the amount of $1000.00, in response to correspondence submitted with the application.

NOW THEREFORE BE IT RESOLVED that Council accepts the applications submitted with respect to the Official Plan Amendment and the Zoning By-law Amendment, deems each of them complete, and directs staff to process the applications in conjunction with the Condominium and Consent applications.

9.    OTHER BUSINESS

Parry Sound & Area Food Charter

WHEREAS a food system includes all of the activities related to how food is produced, processed, distributed, accessed, consumed and disposed of;

WHEREAS food charters are used to highlight collective food-related goals and values of community members, organizations and/or municipalities within a region;

WHEREAS the Township of The Archipelago recognizes the important role municipalities have in shaping local food systems, given the potential municipal impact of food related initiatives on the health of the population and the environment, economic development, tourism and local food production;

WHEREAS the Township of The Archipelago believes the Parry Sound & Area Food Charter will guide the work related to promoting a healthy, sustainable food system for the region;

WHEREAS the Township of The Archipelago values health and wellbeing, sustainable economic development, social equity, healthy ecosystems, food literacy, and culture and collaboration, as outlined in the Parry Sound & Area Food Charter;

NOW THEREFORE BE IT RESOLVED that the Township of The Archipelago endorse the Parry Sound & Area Food Charter; and

FURTHERMORE BE IT RESOLVED that the Township of The Archipelago will support efforts related to creating public policies and supportive environments that promote healthy, sustainable food system within the region; and

FURTHERMORE BE IT RESOLVED that correspondence for this endorsement be shared with other municipalities in the Nipissing and Parry Sound districts to encourage support for the Parry Sound & Area Food Charter.

Tax Write-Offs

NOW THEREFORE BE IT RESOLVED that Council authorizes the following tax write-offs for 2016:

        TOTAL NORTH:    $ 11,618.67

North Bay Parry Sound District Health Unit.  Environmental Health Program Funding

WHEREAS Council for the Township of The Archipelago has received a request for support of a resolution enacted by the Board of Health for the North Bay Parry Sound District Health Unit regarding the Environmental Health Program Funding;

NOW THEREFORE BE IT RESOLVED that Council supports the resolution enacted by the Board of Health for the North Bay Parry Sound District Health Unit that endorses the following actions to support the Environmental Health Program in implementing new provincial public health policy and legislation:

1.    Encourage the Ontario Ministry of Health and Long-Term Care to provide dedicated, predictable recurring funding to public health units for the purpose to enhance Environmental Health program field staff and management capacity to implement new provincial public health policy and legislation;

2.    Encourage the Ontario Ministry of Health and Long-Term Care to fund an additional 2.0 full-time equivalent (FTE) public health inspectors in the Environmental Health program;

3.    Encourage the Ontario Ministry of Health and Long-Term Care to adopt as standard policy for providing of training to public health staff whenever new provincial public health policy and legislation is implemented; and

4.    Encourage the Ministry of Health and Long-Term Care to develop a staffing model for health units to use to determine adequate levels of environmental health staffing which include field staff, supervisory staff and management staff necessary to fully implement provincial environmental health policy and legislation.

AND BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to the Honourable Dr. Eric Hoskins, Minister of Health and Long-Term Care, Dr. Bob Bell, Deputy Minister of Health and Long-Term Care, Roselle Martino, Assistant Deputy Minister of Health and Long-Term Care, Dr. David Williams. Interim Chief Medical Officer of Health for the Ministry of Health and Long-Term Care, the Association of Local Public Health Agencies, Ontario Medical Officers of Health, and Ontario Boards of Health, and member municipalities.

The Town of Northeastern Manitoulin and the Islands.  Request Province to
increase funding to Long Term Care Facilities

WHEREAS Council for the Township of The Archipelago has received a request for support of a resolution enacted by The Town of Northeastern Manitoulin and the Islands regarding lack of long term care funding from the province;

NOW THEREFORE BE IT RESOLVED that Council supports the resolution enacted by The Town of Northeastern Manitoulin and the Islands which requests the Province to increase funding to Long Term Care Facilities; and

AND BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to the Minister of Health, Dr. Eric Hoskins, MPP Norm Miller, MPP Michael Mantha, The Town of Northeastern Manitoulin and the Islands, Shawanaga First Nation, Wasauksing First Nation, the West Parry Sound Municipalities and the District of Parry Sound Municipal Association for support.

                        Carried.

Crossing at CP Parry Sound Subdivision Mile 48.94, North Shore Rd.

Staff advised Council that due to safety concerns they will be fighting the full closure of North Shore Road which is scheduled in August, as well as the costs.

Council recessed for a meeting of the Committee of Adjustment at 11:00 a.m. and resumed business at 11:55 a.m.

Tax Sale Property – Surplus Funds.

Councillor French requested a recorded vote.

WHEREAS the Township of The Archipelago Council has become aware of receipt of significant surplus funds from a tax sale at 3 Pattison Lane;

AND WHEREAS Council has heard deputations from the former owner’s lawyer;

AND WHEREAS Council has satisfied itself of the health and other considerations unique to this former owner/ratepayer and tax sale process, which processed fully met all legal requirements of the Municipal Tax Sale Act R.S.O. 1990;

AND WHEREAS the Township wishes to release excess funds applied for by the former owner due to the unique circumstances of this tax sale only;

AND WHEREAS the lawyer representing the affected former ratepayer indicated he was doing so without any fee or contingency fee agreement;

NOW THEREFORE BE IT RESOLVED that the Township of the Archipelago will forthwith grant all funds recovered in excess of those owed to the Township, without creating any precedent with other past or future tax sales.

Pointe au Baril Ice Rink/Removal of Boards

Staff updated Council that the boards from the rink will be removed for the summer, as the rink will be a part of the construction area for the new nursing station.  The rink will not be available this year for Lobster Fest.

Update on meeting with Parliamentary Assistant to the Minister of the MNRF

Reeve Ketchum updated Council on his meeting with Eleanor McMahon, the Parliamentary Assistant to the Minister of the Natural Resources and Forestry.  Discussions included the MNRF tower and The Archipelago’s pursuit to acquire it; the changes in MNRF’s policies for docks and single storey boathouses that occupy more than 15 square metres of (shadow) area over the Crown lake bed; and the request for assistance to arrange a meeting with Shawanaga First Nation’s to discuss their proposed use of Crown Islands for buildings.

Reeve Ketchum advised Council that he will be crafting a letter to follow up on the assurances that were made at the meeting.

Indemnification By-law

That By-law Number 2016-07, being a By-Law to Provide Indemnification for Members of Council, Local Boards, Committees, Employees or Former Employees With Respect to Certain Actions or Proceedings Arising From Their Duties be read and finally passed in Open Council this 18th day of March, 2016.

11.    CONFIRMING BY-LAW
