Cale Henderson, Planner, explained the nature of the application. John, Jessica and Janet Foster, were in attendance in support of the application.

RESOLUTION PB14-09-03

NOW THEREFORE BE IT RESOLVED that Application No. B11-14, to grant a right-of-way across the lands located at 43 Crane Lake Water, more particularly, Part 8 on Plan 42R-3206, to the owners of the property being 19 Crane-Country Lane, be approved.

DISPOSITION CARRIED

The Planning Board made the following Decision with respect to Application No. B11-14:

Application No. B11-14, is to grant a right-of-way across the lands located at 43 Crane Lake Water, more particularly, Part 8 on Plan 42R-3206, to the owners of the property being 19 Crane-Country Lane, as illustrated on the attached sketch, be approved, subject to the attached conditions:

1.  That the approval of Consent Application No. B11-14 shall apply to the transfer of a right-of-way in favour of Part 5 on Plan 42R-5245, from the owners of Part 8 on Plan 42R-3206, located in Part Lot 23, Concession 8, in the geographic Township of Conger.

2.   That the following documents be provided for the transaction as described in Condition No. 1 above:

a)  The Transfer document which depicts the legal description of the subject parcel(s) and the names of the transferor(s) and transferee(s);

b)  A schedule to the Transfer document on which is set out the legal description of the subject parcel. Each schedule must also bear the same names of the transferor(s) and transferee(s) as indicated on page 1 of the Transfer document;

3.  That an Agreement be registered on title of the subject and benefitting properties of the rights-of-way, pursuant to Section 51(26) of the Planning Act, R.S.O, as amended, indemnifying the Township of The Archipelago and all other public bodies of all responsibility for any maintenance of the road and all liability for any use of the road and alleged failure to provide emergency services or any other public service.

Reasons for the Decision:

1.  The requested consent conforms to the criteria as set out in Section 51(24) of the Planning Act, R. S.O. 1990.
2.  The requested consent appears to conform to the Provincial Policy Statement.
3.  The requested consent appears to conform to the Official Plan policies for the Township of The Archipelago.
4.  The requested consent complies with the By-law regulations of Comprehensive Zoning By-law No. A2000-07, as amended.
5.  The requested consent will create an appropriate land use.

b)  Jones/Stocker – Application Nos. B12-14, B13-14
     Part Lot 33, Concession 9, being Part 7 on Plan
     PSR-1556, in the geographic Township of Shawanaga

NOW THEREFORE BE IT RESOLVED that Application Nos. B12-14 and B13-14, to transfer a lot addition being approximately 0.09 hectares (0.2 acres) in area from Part 7 on Plan PSR-1556 to be added to Part 12 on Plan PSR-1516, and to transfer a lot addition being approximately 0.24 hectares (0.6 acres) in area from Part 7 on Plan PSR-1556 to be added to Part 6 on Plan PSR-1556, located in Part of Lot 33, Concession 9, in the geographic Township of Shawanaga, be approved.

Application No. B12-14, to transfer a lot addition being approximately 0.09 hectares (0.2 acres) in area, from Part 7 on Plan PSR-1556 to be added to Part 12 on PSR-1516, located in Part of Lot 33, Concession 9, in the geographic Township of Shawanaga, as illustrated on the attached sketch, be approved, subject to the attached conditions:

1. That the approval of Consent Application No. B12-14 shall apply to the transfer of a lot addition being approximately 0.09 hectares (0.2 acres) in area, from Part 7 on Plan PSR-1556 to be added to Part 12 on PSR-1516, located in Part of Lot 33, Concession 9, in the geographic Township of Shawanaga.

2.  That the following documents be provided for the transaction as described in Condition No. 1 above:

a) The Transfer document which depicts the legal description of the subject parcel(s) and the names of the transferor(s) and transferee(s);

b)  A schedule to the Transfer document on which is set out the legal description of the subject parcel. Each schedule must also bear the same names of the transferor(s) and transferee(s) as indicated on page 1 of the Transfer document;

c)  A reference plan of survey bearing the Land Registry Office registration number and signature as evidence of its deposit therein, and which illustrates the parcels to which the consent approval is related. Prior to having the survey plan registered, the Board will require a copy of a draft plan from your surveyor to ensure it is in compliance with the approved application;

3.  That the 'Holding' provision be removed from the subject lands;

4.  All conditions are subject to the approval of The Archipelago Area Planning Board, but are at no cost to the Planning Board.

7.   PLAN OF SUBDIVISION APPLICATIONS

8.   ADMINISTRATION

a)  REQUEST FOR FEE REDUCTION – MS. JONES

RESOLUTION PB14-09-05

Seconded by J. Hansuld

WHEREAS Patricia Jones submitted an application for consent to sever a lot; adding a portion of it to an adjacent property and adding the remaining portion of it to the abutting property on the opposite side, thereby eliminating a General Residential 'Holding' lot, being Part 7 on Plan PSR-1556, in the geographic Township of Shawanaga ;

AND WHEREAS Ms. Jones requested a reduction in the fee because she believed she was effectively assisting the Township by disposing of an inadequate lot in the Skerryvore community;

NOW THEREFORE BE IT RESOLVED that The Archipelago Area Planning Board hereby authorizes staff to refund Ms. Jones the entire amount of $1,200.00 which she submitted for the consent application.

b)  PROTOCOL WHEN DECLARING A PECUNIARY INTEREST OR A CONFLICT

Members had a discussion with respect to proper protocol when declaring a pecuniary interest or a conflict, specifically; whether or not the member making the declaration should leave the meeting. Chair Christie informed the members that the Township's legal Counsel recommended that the member making the declaration leave the Council Chamber entirely. At the end of the discussion it was decided that the onus was on the member declaring a pecuniary interest or conflict as to whether or not they felt the need to excuse themselves from the meeting entirely.
