1.   MEETING CALLED TO ORDER

Chair Hansuld called the meeting to order at 1:01 p.m.

5.   ADMINISTRATION

Two persons were nominated for the position of Chair for The Archipelago Area Planning Board for the year 2014; Gary French and Ted Christie.

Two persons were nominated for the position of Vice Chair for the Committee of Adjustment for the year 2014; John Hansuld and Grant Walker.

John Hansuld withdrew his name from the list of nominees.

NOW THEREFORE BE IT RESOLVED that pursuant to Section 11(2) of the Planning Act, R.S.O.1990,c.P.13, as amended, Ted Christie is hereby appointed as Chair of The Archipelago Area Planning Board and Grant Walker is hereby appointed as Vice Chair, who shall preside in the absence of the Chair.

Stephen Wohleber thanked both Chair French and Vice Chair Hansuld for their many years of service.


Ted Christie assumed the duties of Chair for the duration of the meeting.


6.   CONSENT APPLICATIONS

a)   MELNYK, David – Application No. B13-13

Part of Island 3464, being Parcel 3012 PSNS, Location AE307, French River, in front of the Unincorporated Township of Mowat

Cale Henderson, Planner, explained the nature of the application. Mr. David Melnyk; owner, was in attendance in support of the application.

RESOLUTION PB14-01-04

NOW THEREFORE BE IT RESOLVED that Application No. B13-13, to create one new water-access lot located on Part of Island 3464, being Parcel 3012 PSNS, Location AE307, French River, in front of the Unincorporated Township of Mowat, be approved.

DISPOSITION CARRIED

The Planning Board made the following Decision with respect to Application No. B13-13:

Application No. B13-13 to create one new lot being approximately 1.5 hectares (3.7 acres) in size with 71 metres (233 feet) of frontage, as well as retained lands being approximately 1.8 hectares (4.4 acres) in size with 91 metres (299 feet) of frontage, as illustrated on the attached sketch, be approved, subject to the attached conditions:

1.  That the approval of Consent Application No. B13-13 shall apply to the creation of one new residential lot located on Part of Island 3464, being Parcel 3012 PSNS, designated as Location AE307, in the French River, fronting the Unincorporated Township of Mowat

2.  That the following documents be provided for the transaction as described in Condition No. 1, above:

a)  The original executed Transfer/Deed of Land which depicts the legal description of the subject parcel(s) and the names of the transferor(s) and transferee(s);

b)  A schedule to the Transfer/Deed of land on which is set out the legal description of the subject parcel and describing the lots. Each schedule must also bear the same names of the transferor(s) and transferee(s) as indicated on page 1 of the Transfer/Deed of Land;

c)  A reference plan of survey bearing the Land Registry Office registration number and signature as evidence of its deposit therein, and which illustrates the parcels to which the consent approval is related. Prior to having the survey plan registered the Board will require a copy of a draft plan from your surveyor to ensure it is in compliance with the approved application;

3.  Confirmation from a qualified septic installer that a suitable location for the construction of a septic system is available on the proposed new lot;

4.  Confirmation from a qualified surveyor, that the retained and severed Lands maintain a minimum lot area of 0.5 hectares and a minimum lot frontage of 70 metres, as per By-law No. PB00-01 (Minimum Standards By-law) for the Unincorporated areas within The Archipelago Area Planning Board.

5.  All conditions are subject to the approval of The Archipelago Area Planning Board, but are at no cost to the Planning Board.

Reasons for the Decision:

1.   The requested consent conforms to the criteria as set out in Section 51(24) of the Planning Act, R. S.O. 1990.
2.   The requested consent appears to conform to the Provincial Policy Statement.
3.   The requested consent complies with the By-law regulations of By-law No. PB00-01 (The Minimum Standards By-law)
4.   The requested consent will create an appropriate land use.

b)   BRADSHAW, James – Application Nos. B04-11,B05-11,B06-11

Cale Henderson, Planner, explained the nature of the application. Mr. Tim Bradshaw and Mr. Paul Forth, agents for the owner, were in attendance in support of the applications.

RESOLUTION PB14-01-05

NOW THEREFORE BE IT RESOLVED that Application Nos. B04-11, B05-11 and B06-1, to create two new water-access lots and to transfer a lot addition, located on Part of Island 501A, being Parcel 8712 PSSS, in front of the geographic Township of Shawanaga, be approved.

DISPOSITION CARRIED

The Planning Board made the following Decisions with respect to Application Nos. B04-11, B05-11 and B06-11:

Application No. B04-11, to create one new residential lot on Part of Island 501A, being Parcel 8712 PSSS, in front of the geographic Township of Shawanaga,, being approximately 2.7 hectares (6.8 acres) in size, having 275 metres (900 feet) of frontage be approved, subject to the attached conditions:

1.  That the approval of Consent Application No. B04-11 shall apply to the creation of a residential lot on Part of Island 501A, being Parcel 8712 PSSS, in front of the geographic Township of Shawanaga.

2.  That the following documents be provided for the transaction as described in Condition No. 1 above:

a)  The original executed Transfer document which depicts the legal description of the subject parcel(s) and the names of the transferor(s) and transferee(s);

b)  A schedule to the Transfer document on which is set out the legal description of the subject parcel. Each schedule must also bear the same names of the transferor(s) and transferee(s) as indicated on page 1 of the Transfer document;

c)  A reference plan of survey bearing the Land Registry Office registration number and signature as evidence of its deposit therein, and which illustrates the parcels to which the consent approval is related. Prior to having the survey plan registered, the Board will require a copy of a draft plan from your surveyor to ensure it is in compliance with the approved application;

3. Confirmation from a qualified surveyor that the subject property meets the 10 hectare (24.7 acre) minimum size to be eligible to apply for severance.

4.  That the retained and severed lots be rezoned from the 'Coastal/Island Residential (CR)' Zone to the 'Coastal/Island Residential/Divided (CR/D)' Zone in accordance with the recommendations within this report.

5.  Development agreements be entered for the retained and severed lands to implement the recommendations within the Ecological Site and Impact Assessment report submitted with the application.

6.  Confirmation from a qualified septic installer that a suitable location for the construction of a septic system is available on the proposed residential lots;

NOTE:

Application No. B05-11, to create one new residential lot on Part of Island 501A, being Parcel 8712 PSSS, in front of the geographic Township of Shawanaga,, being approximately 3.2 hectares (7.9 acres) in size, having 170 metres (560 feet) of frontage be approved, subject to the attached conditions:

1.  That the approval of Consent Application No. B05-11 shall apply to the creation of a residential lot on Part of Island 501A, being Parcel 8712 PSSS, in front of the geographic Township of Shawanaga.

2.  That the following documents be provided for the transaction as described in Condition No. 1 above:

a)  The original executed Transfer document which depicts the legal description of the subject parcel(s) and the names of the transferor(s) and transferee(s);

b)  A schedule to the Transfer document on which is set out the legal description of the subject parcel. Each schedule must also bear the same names of the transferor(s) and transferee(s) as indicated on page 1 of the Transfer document;

Application No. B06-11, to transfer a lot addition being approximately 1.5 hectares (3.7 acres) in size, from Parcel 8712 PSSS, to be added to Parcel 12937 PSSS, on part of Island 501A, in front of the geographic township of Shawanaga, be approved, subject to the attached conditions:

1.  That the approval of Consent Application No. B06-11 shall apply to the transfer of a lot addition being approximately 1.5 hectares (3.7 acres) in size, on part of Island 501A, being Parcel 8712 PSSS, in front of the geographic Township of Shawanaga.

2.  That the following documents be provided for the transaction as described in Condition No. 1 above:

a)  The original executed Transfer document which depicts the legal description of the subject parcel(s) and the names of the transferor(s) and transferee(s);

b)  A schedule to the Transfer document on which is set out the legal description of the subject parcel. Each schedule must also bear the same names of the transferor(s) and transferee(s) as indicated on page 1 of the Transfer document;

c)  A reference plan of survey bearing the Land Registry Office registration number and signature as evidence of its deposit therein, and which illustrates the parcels to which the consent approval is related. Prior to having the survey plan registered, the Board will require a copy of a draft plan from your surveyor to ensure it is in compliance with the approved application;

3.  That the retained and severed lots be rezoned from the 'Coastal/Island Residential (CR)' Zone to the 'Coastal/Island Residential/Divided (CR/D)' Zone in accordance with the recommendations within this report.

4.  The lands benefiting from the lot addition shall be prohibited from further lot creation.

5. Development agreements be entered for the retained and severed lands to implement the recommendations within the Ecological Site and Impact Assessment report submitted with the application.

Cale Henderson, Planner, explained the nature of the applications and summarized the report submitted to the Planning Board.

RESOLUTION PB14-01-06

NOW THEREFORE BE IT RESOLVED that Application Nos. B27-13, B28-13, B29-13, B30-13, B31-13 and B32-13 , to grant legal rights-of-way in favour of Part 1 on Plan 42R-18179, and Lots 6 through 10 on Plan M-602, from the owners of Part 1 on Plan 42R-12906, Part 1 on Plan 42R-18179, and Lots 7 through 10 on Plan M-602, located Part Lot 27, Concession 5, in the geographic Township of Harrison, be approved.

DISPOSITION CARRIED

The Planning Board made the following Decisions with respect to Application Nos. B27-13 through B32-13:

Application Nos. B27-13 through B32-13, to grant legal rights-of-way in favour of Part 1 on Plan 42R-18179, and Lots 6 through 10 on Plan M-602, from the owners of Part 1 on Plan 42R-12906, Part 1 on Plan 42R-18179, and Lots 7 through 10 on Plan M-602, located Part Lot 27, Concession 5, in the geographic Township of Harrison, be approved, subject to the attached conditions:

1.  That the approval of Consent Application Nos. B27-13 through B32-13, shall apply to the transfer of rights-of-way in favour of Part 1 on Plan 42R-18179, and Lots 6 through 10 on Plan M-602, from the owners of Part 1 on Plan 42R-12906, Part 1 on Plan 42R-18179, and Lots 7 through 10 on Plan M-602, located Part Lot 27, Concession 5, in the geographic Township of Harrison;

2.  That the following documents be provided for the transactions as described in Condition No. 1 above:

a)  The Transfer documents which depict the legal descriptions of the subject parcel(s) and the names of the transferor(s) and transferee(s);

b)  A schedule to the Transfer documents on which is set out the legal descriptions of the subject parcels. Each schedule must also bear the same names of the transferor(s) and transferee(s) as indicated on page 1 of the Transfer document;

c)  A reference plan of survey bearing the Land Registry Office registration number and signature as evidence of its deposit therein, and which illustrates the parcels to which the consent approval is related. Prior to having the survey plan registered, the Board will require a copy of a draft plan from your surveyor to ensure it is in compliance with the approved application;

3.  That an Agreement be registered on title of each of the subject properties, pursuant to Section 51(26) of the Planning Act, R.S.O, as amended, indemnifying the Township of The Archipelago and all other public bodies of all responsibility for any maintenance of the road and all liability for any use of the road and alleged failure to provide emergency services or any other public service.

4.  An entrance permit be granted, to allow for the increase in usage of the previously approved driveway entrance, from the Public Works Superintendent.

Reasons for the Decision:

1)  The requested consent conforms to the criteria as set out in Section 51(24) of the Planning Act, R. S.O. 1990.
2)  The requested consent appears to conform to the Provincial Policy Statement.
3)  The requested consent appears to conform to the Official Plan policies for the Township of The Archipelago.
