6.   Hearing of Minor Variance Applications

i)   REICHENBACH, Angela and Steven – Application A06-14
     Island DB 71, being Parcel 12736 PSSS
     in the geographic Township of Conger

PURPOSE AND EFFECT OF THE APPLICATION:

The applicant is requesting relief from Section 7.1.3 e) Minimum Front Yard Setback, of the Township's Comprehensive Zoning By-law No. A2000-07, as amended, which stipulates that the minimum front yard setback shall be 7.5 metres (25 feet).

The purpose of the proposed application is to allow a variance of 1.2 metres (4 feet) from the minimum front yard setback of 7.5 metres (25 feet). The effect of the variance would be the construction of a 1.9 square metre (20 square feet) composting toilet building, which would have a front yard setback of 6.3 metres (21 feet).

The owners have stated that the reason they cannot comply with the front yard setback is because of the topography on the island. It is quite steep and rocky behind the bunkie where the building is proposed to be situated.

Cale Henderson; Planner, explained the nature of the application. Mr. Reichenbach attended in support of the application.

The Committee made the following Decision with respect to Application No. A06-14.

DECISION

Application No. A06-14, to grant a variance from Section 7.1.3 e) of the Township's Comprehensive Zoning By-law No. A2000-07, as amended, to allow the construction of a 1.9 square metre (20 square feet) composting toilet building, which would have a front yard setback of 6.3 metres (21 feet) be approved.

Reasons for the Decision:

It is the opinion of the Committee that the requested variance:

i)     is minor in nature;
ii)    is desirable for the appropriate development or use of the land, building or structure;
iii)   maintains the intent and purpose of Comprehensive Zoning By-law A2000-07, as amended;
iv)   maintains the intent and purpose of the Official Plan;
