6.  Hearing of Minor Variance Applications

i)  KROUPA, Milan – Application A04-14

in the geographic Township of Conger

PURPOSE AND EFFECT OF THE APPLICATION:

The applicant is requesting relief from Section 7.1.3 e) Minimum Front Yard Setback, of the Township's Comprehensive Zoning By-law No. A2000-07, as amended, which stipulates that the minimum front yard setback shall be 7.5 metres (25 feet).

The purpose of the proposed application is to allow a variance of 3.35 metres (11 feet) from the minimum front yard setback of 7.5 metres (25 feet). The effect of the variance would be the construction of a 35.7 square metre (384 square feet) boat storage building having a front yard setback of 4.27 metres (14 feet). Attached to the boat storage building would be a ramp to allow the hovercraft access to and from the water.

The owners have stated that the reason for this application is because of the topography of the island that the building is being constructed for their hovercraft.

Cale Henderson; Planner, explained the nature of the application. Mr. Anthony Dion and Ms. Deanna Dion attended in support of the application. Holly Christie and Gerry Haarmeyer were also in attendance.

Application No. A04-14, to grant a variance of 3.35 metres (11 feet) from the minimum front yard setback of 7.5 metres (25 feet), for the construction of a 35.7 square metre (384 square feet) boat storage building, with a ramp to allow hovercraft access, be approved.

The Committee made the following Decision with respect to Application No. A04-14.

DECISION

Application No. A04-14, to grant a variance of 3.35 metres (11 feet) from the minimum front yard setback of 7.5 metres (25 feet), for the construction of a 35.7 square metre (384 square feet) boat storage building, with a ramp to allow hovercraft access, be approved.

Reasons for the Decision:

It is the opinion of the Committee that the requested variance:

i)   is minor in nature;
ii)  is desirable for the appropriate development or use of the land, building structure;
iii)  maintains the intent and purpose of Comprehensive Zoning By-law No. A2000-07, as amended;
iv)  maintains the intent and purpose of the Official Plan.

PURPOSE AND EFFECT OF THE APPLICATION:

The applicant is seeking relief from Section 5.2 c) iii) of the Township's Comprehensive Zoning By-law No. A2000-07, which restricts the reconstruction of legal non-complying buildings to their existing uses and Section 5.7 b) of said By-law, which requires that decks attached to accessory buildings maintain a front yard setback of 7.5 metres.

The purpose of the proposed application is to allow for the existing legally non complying accessory building, which historically was used as a studio/workshop, to be reconstructed and replaced with a sauna/screened in porch with an attached uncovered deck.

The effect of the proposed variance will result in replacing the 53.5 square metre (576 square feet) non-complying studio/workshop, with a new 31 square metre (336 square feet) sauna/screened in porch, with a setback of 3.7 metres (12 feet) and attached 22 square metre (240 square feet) uncovered deck. The historical studio/workshop had a front yard setback of 1.8 metres (6 feet). The proposal would permit the change in use and an uncovered deck with a front yard setback of 1.8 metres (6 feet), which is a variance of 5.7 metres (18.7 feet).
