6.  Hearing of Minor Variance Applications

i)   BRYCE, Douglas, et al – Application A03-14

Island 452A, being Parcel 1187 PSNS, in front
of the geographic Township of Shawanaga

PURPOSE AND EFFECT OF THE APPLICATION

The applicant is seeking relief from Sections 5.36a)ii) and 5.22 c)vi) of the Township's Comprehensive Zoning By-law, as amended, which limits the maximum number of sleeping cabins to three and prohibits the expansion or enlargement of legally non-complying accessory buildings.

The purpose of the proposed application is to allow for a fifth sleeping cabin and the enlargement of a legally existing, non-complying sleeping cabin.

The effect of the proposed variance will result in an 11.1 square metre (120 square feet) addition to the existing 21.9 square metre (236 square feet), legal, non-complying sleeping cabin resulting in a 33 square metre (356 square feet) sleeping cabin. The sleeping cabin is considered non-complying because there are 4 sleeping cabins on the property. In addition, the applicants are proposing a new 18 square metre (196 square feet) sleeping cabin, which would be the fifth sleeping cabin on the property.

Cale Henderson, Planner, explained the nature of the application. Mr. Douglas Bryce and Mr. Peter Bryce attended in support of the application.

The Committee made the following Decision with respect to Application No. A03-14.

DECISION

Application No. A03-14, to grant a variance from Sections 5.36a)ii) and 5.22 c)vi), to allow for an 11.1 square metre (120 square feet) addition to the existing 21.9 square metre (236 square feet), legal, non-complying sleeping cabin, as well as a new 18 square metre (196 square feet) sleeping cabin, be approved.

Reasons for the Decision:

It is the opinion of the Committee that the requested variance:

i)    is minor in nature;
ii)   is desirable for the appropriate development or use of the land, building or structure;
iii)  maintains the intent and purpose of Comprehensive Zoning By-law A2000-07, as amended;
iv)  maintains the intent and purpose of the Official Plan.
