6.   Hearing of Minor Variance Applications

PURPOSE AND EFFECT OF THE APPLICATION

The applicants are seeking relief from Section 6.1.3 h) – Maximum Height – Main Dwelling, of the Township's Comprehensive Zoning By-law No. A2000-07, as amended, which restricts the maximum height of a main dwelling, located in Ward 4, to 6 metres.

The purpose of the proposed application is to allow a variance of 1.89 metres (6.2 feet) from the maximum 6-metre height that is permitted in Comprehensive Zoning By-law No. A2000-07, as amended. The effect of the variance would be the construction of a 294 square metre (3164 square feet) main dwelling, having a maximum height of 7.89 metres (25.9 feet).

The owners have stated that they do not want to blast. The length of the building, the topography of the land, and the desire to retain vegetation, all contribute to choosing this location for the main dwelling, leaving the owners with a main dwelling which will exceed the maximum height on the North side.

Cale Henderson; Planner, explained the nature of the application. The agent; Ms. Christie Hamilton, attended in support of the application.

DECISION

Application No. A13-13, to grant a variance from Section 6.1.3 h) – Maximum Height – Main Dwelling, of the Township's Comprehensive Zoning By-law No. A2000-07, as amended, to allow for the construction of a 294 square metre (3164 square feet) main dwelling, having a maximum height of 7.89 metres (25.9 feet), be denied.

Reasons for the Decision:

It is the opinion of the Committee that the requested variance:

i)    is not minor in nature;
ii)   is not desirable for the appropriate development or use of the land, building or structure;
iii)  does not maintain the intent and purpose of Comprehensive Zoning By-law
A2000-07, as amended;
iv)  does not maintain the intent and purpose of the Official Plan;
