6.   Hearing of Minor Variance Applications

Councillor French declared a conflict and recused himself from the hearing.

i)   DALGLISH, Geordie – Application A01-14

PURPOSE AND EFFECT OF THE APPLICATION:

The applicant is seeking relief from 'Section 5.1.2ii)f) Accessory Structures – Residential' of Comprehensive Zoning By-law No. A2000-07, as amended. The applicant is requesting relief from this provision of the by-law for an addition to an existing, oversized boat storage building. By-law provisions for accessory structures under General Provisions Section 5.1.2 direct that any accessory building or structure must have a total floor area smaller than the ground floor area of the main building.

The owner received relief from the Committee, to construct this oversized boat storage building in 2008 (Application No. A04-08), and states that further contravention to the by-law is necessary because of the need to store larger watercraft.

The applicant wishes to construct a 33 square metre (355 square feet) addition to the existing 63 square metre (678 square feet) boat storage building. The existing main dwelling is 50 square metres (540 square feet) in size.

DECISION

Application No. A01-14, to grant a variance from Section 5.1.2ii)f) Accessory Structures – Residential' of Comprehensive Zoning By-law No. A2000-07, as amended, to construct a 33 square metre (355 square feet) addition to the existing 63 square metre (678 square feet) boat storage building, be approved.

Reasons for the Decision:

It is the opinion of the Committee that the requested variance:

i)  is minor in nature;
ii)  is desirable for the appropriate development or use of the land, building or structure;
iii)  maintains the intent and purpose of Comprehensive Zoning By-law No. A2000-07, as amended;
iv)  maintains the intent and purpose of the Official Plan,
