6.    HEARING OF APPLICATIONS

i)    CAMMAERT, Chad - Application No. A11-17

PURPOSE AND EFFECT OF THE APPLICATION:

The owner is seeking relief from Section 5.36 a) i) Sleeping Cabins, Wards 1,2,3 and 4, which stipulates that the maximum Total Floor Area of each sleeping cabin, does not exceed 50.16 square metres (540 square feet) in size.

The purpose of the proposed application is to allow a variance of 1.84 square metres (19.8 square feet) from the maximum size of a sleeping cabin. The effect of the proposed variance would be to maintain the existing structure. The owner wishes to build a main dwelling and retain the current 52 square metre (560 square feet) building for a sleeping cabin.

PURPOSE AND EFFECT OF THE APPLICATION:

The applicant is seeking relief from Section 6.1.3 f) Minimum Side Yard Setback, of the Township’s Comprehensive Zoning By-law No. A2000-07, as amended, which stipulates that the Minimum Side Yard Setback, is 6 metres (20 feet).

The purpose of the proposed application is to permit a variance of 4.78 metres (15.7 feet) from the Minimum Side Yard Setback. The effect of the proposed variance would be to allow a 49 square metre (527 square feet) sleeping cabin to be constructed having a setback of 1.22 metres (4 feet) from the side lot line.

The owners have stated that the variance is being sought because they are not able to purchase the Crown Reserve fronting their property, which they have been attempting to do since 2006. Because they do not have ownership of the Crown Reserve, they are limited as to where they can place the sleeping cabin due to the terrain and shape of the property. A survey was performed to determine the best area to place to sleeping cabin. Neighbouring lands, to the east of the property, is Crown land.
