                                PURPOSE AND EFFECT OF THE APPLICATION:       

The owners are seeking relief from Section 5.36 a) i) Sleeping Cabins, Wards 1,2,3 and 4, which stipulates that the maximum Total Floor Area of each sleeping cabin, including the floor area of any basement, does not exceed 50.16 square metres (540 square feet) in size.

The purpose of the proposed application is to allow a variance of 6.7 square metres (72 square feet) from the maximum size of a sleeping cabin. The effect of the proposed variance would be the construction of a sleeping cabin, having a total floor area of 56.86 square metres (612.1 square feet).

Because of the design of the sleeping cabin, the roof of the building includes an overhang which, because of its size, causes that portion of the deck situated under the roof to be included in the calculation of the total floor area.

                                PURPOSE AND EFFECT OF THE APPLICATION:

The applicants are seeking relief from ‘Section 5.22c) Non Complying Buildings & Structures i) – Horizontal Extension Permitted – Front and Side Yards i) and ii), of the Township's Comprehensive Zoning By-law No. A2000-07, as amended. Section 5.22 c)i) and ii) state that the enlargement of a legal non-complying main dwelling, that does not comply with the side yard requirements, may be permitted provided the expansion or extension does not exceed 50% of the total ground floor area of the existing dwelling and that the wall which encroaches into the side yard cannot be extended by more the 50% of the length of the existing wall.

The purpose of the proposed application is to permit the enlargement of an existing 90.57 square metre (974.9 square feet) main dwelling that encroaches into the minimum required side yard setback. The length of the existing wall that encroaches into the side yard setback is 8.62 metres (28.3 feet).

Firstly, the effect of the variance would be the construction of an addition being 155 square metres (1673 square feet) in area, which would require a variance of 110 square metres (1184 square feet). Secondly, the effect of the variance would be the extension of the length of the encroaching wall by 19.2 metres (63 feet), which would require a variance of 14.8 metres (49 feet). The relief is being sought because the location of the existing main dwelling is 4.57 metres (15 feet) from the side lot line.
